An Indian student’s dream of studying at a top American university has ended in a visa denial. The engineering graduate was accepted into a prestigious computer science program for the Spring 2026 intake. His plans were halted by a consular officer who rejected his application under Section 214(b).

He was initially accepted for a Fall 2025 intake but deferred to Spring 2026 due to visa processing delays. He attended his long-awaited visa interview after a three-hour wait in line.

The consular officer denied his F-1 visa application. The refusal was based on Section 214(b) of the Immigration and Nationality Act. This section allows officers to refuse visas if they believe the applicant will not return home after their studies. The student felt the decision was made with little consideration for his strong qualifications.

A System Deemed “Borderline Arbitrary”

The student described the experience as “nothing short of cruel.” He criticized a system that relies heavily on a single officer’s subjective judgment during a brief interview. He argued that the process offers limited opportunity for applicants to fully present their case.

He suggested concrete reforms to increase fairness. These included requiring officers to provide more detailed refusal reasons and creating a formal appeals process. He also pointed to online forums where applicants with nearly identical profiles received different outcomes, calling the system “borderline arbitrary.”

The student’s final decision was to walk away for good, choosing his current career and personal well-being over what he now calls a “fleeting dream.”
