A major legal fight in professional racing is moving to mediation. NASCAR and two of its top teams will attempt to settle an antitrust lawsuit this week. The proceedings begin Tuesday in Charlotte, North Carolina.

NASCAR antitrust lawsuit

This step comes just weeks before a scheduled federal trial. The dispute centers on NASCAR’s charter system and its financial fairness for team owners.

Teams Challenge NASCAR’s Charter System as Anti-Competitive

The lawsuit was filed in October 2024 by 23XI Racing and Front Row Motorsports. Both teams refused to sign a new charter agreement for the 2025 season. They accuse NASCAR and the France family of anti-competitive practices.

According to Field Level Media, the charter system was created in 2016. It guarantees a team a spot in every race. However, team owners argue these charters do not create the same value as franchises in leagues like the NFL or NBA.

Mediation Aims to Avoid December Trial

U.S. District Judge Kenneth D. Bell will oversee the mediation. He is the same judge scheduled to preside over the trial on December 1. A summary judgment hearing is also set for Thursday.

The outcome of these hearings will determine if the case proceeds. A settlement would avoid a public and potentially damaging trial for the sport. The teams seek a system that offers greater long-term value.

The resolution of this NASCAR antitrust lawsuit could reshape the business model of professional stock car racing. All parties are now under pressure to find a compromise before the December trial date arrives.

Who is involved in the lawsuit?

The plaintiffs are the race teams 23XI Racing and Front Row Motorsports. They are suing NASCAR and the France family. The France family controls the racing organization.

A charter is a license that guarantees a team a spot in every Cup Series race. The system was introduced in 2016. It is often compared to a franchise in other major sports leagues.

What happens if mediation fails?

If mediation fails, the case will proceed to a federal trial. The trial is currently scheduled to begin on December 1. A judge will then make a final ruling on the allegations.

Why did the teams file this lawsuit?

The teams want a more fair and competitive financial system. They believe the current model prevents them from building long-term enterprise value. This is a core issue for team sustainability.
