Sixteen states and Washington D.C. have filed a lawsuit against the U.S. Department of Health and Human Services. The legal action was taken on Friday in a federal court in Oregon. The states allege the Trump administration is illegally threatening to cut crucial sexual education grants.

The dispute centers on new conditions tied to federal funding. According to Reuters, the administration is demanding that states remove references to diverse gender identities from their curricula.

Legal Battle Over Federal Grant Conditions

The lawsuit claims HHS violated federal law by imposing new grant requirements. These requirements were not authorized by Congress. The administration warned states they had 60 days to change their educational materials or lose funding.

Programs at risk include the Personal Responsibility Education Program (PREP). The Title V Sexual Risk Avoidance Education program is also affected. These grants fund lessons on abstinence and contraception to prevent pregnancy and STIs.

California has already lost its $12 million PREP grant. This happened on August 21. The total potential loss for all plaintiff states exceeds $35 million.

Broader Impact on Student Health and State Rights

State officials argue the administration’s move harms public health. Washington Attorney General Nick Brown stated HHS threatened funding over a single sentence in a curriculum. That sentence affirmed that people of all gender identities need health information.

Minnesota Attorney General Keith Ellison called the ultimatum unacceptable. He said states should not have to choose between funding and inclusive education. The lawsuit describes the action as part of a broader effort to target transgender youth.

The states of Oregon, Washington, and Minnesota are leading the legal challenge. Other plaintiffs include New York, New Jersey, Illinois, and Massachusetts. The outcome could set a significant precedent for federal spending power.

This lawsuit highlights a major clash over educational content and federal authority. The sexual health education funding dispute now rests with the courts. Their decision will directly impact health programs for young people across the nation.

Q1: Why are the states suing the Trump administration?

The states are suing because the Department of Health and Human Services threatened to cut federal grants. The cuts are tied to sexual health curricula that mention diverse gender identities. The states argue this action is illegal and violates congressional spending rules.

Q2: How much funding is at risk?

The total funding loss for the 16 states and Washington D.C. could be at least $35 million. California has already lost its $12 million grant. The money supports programs that teach pregnancy and STI prevention.

Q3: What are the PREP and SRAE programs?

PREP and SRAE are federal grant programs. They provide funding for sexual health education. The lessons focus on abstinence and contraception to improve teen health outcomes.

Q4: What is the administration’s justification for the funding threat?

The Trump administration seeks to recognize people as only male or female. It aims to prohibit what it calls “gender ideology” in federally funded lessons. Officials have not yet publicly commented on the lawsuit.

Q5: Which states are involved in the lawsuit?

The lawsuit is led by Oregon, Washington, and Minnesota. Other plaintiffs include Colorado, Connecticut, Delaware, Hawaii, Illinois, Massachusetts, Maryland, Maine, Michigan, New Jersey, New York, Rhode Island, Wisconsin, and the District of Columbia.
